By accessing, browsing, or using the website located at www.alphatraderfirm.com (the "Website") or any services offered by Alpha Trader Firm LLC ("Company," "we," "our," or "us"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, Legal Disclosure, and Cookies Policy, which are incorporated herein by reference.
If you do not agree to these Terms, you must immediately discontinue use of our Website and services. Your continued use of the platform constitutes ongoing acceptance of these Terms and any amendments thereto.
These Terms constitute a legally binding agreement between you and Alpha Trader Firm LLC. We reserve the right to modify these Terms at any time, with or without notice. Material changes will be communicated via email or prominent notice on our platform.
To use our services, you must: be at least 18 years of age (or the age of majority in your jurisdiction); have the legal capacity to enter into binding agreements; not be located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. sanctions (including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine); not be listed on any U.S. or international sanctions list, including OFAC's Specially Designated Nationals and Blocked Persons List; and provide accurate, current, and complete information during registration.
We reserve the right to refuse service to any individual or entity at our sole discretion, without obligation to provide a reason.
Alpha Trader Firm provides simulated trading evaluation services only. We are not a broker, dealer, exchange, financial institution, investment adviser, commodity trading adviser, futures commission merchant, or any other type of regulated financial entity.
Our services consist of providing access to simulated (demo) trading environments where participants can demonstrate their trading discipline and decision-making abilities. All trading activity on our platform occurs in a simulated environment using virtual funds. No real financial instruments are traded, no real capital is at risk, and no real market orders are placed, executed, or settled through our platform.
Fees paid to Alpha Trader Firm are for access to our evaluation services and educational programs. They are not investments, deposits, or capital contributions of any kind.
IMPORTANT: No trades are routed, placed, matched, cleared, settled, or executed through any broker, exchange, ECN, ATS, SEF, DCM, or any other trading venue. All simulations take place within third-party demo platforms using virtual funds only.
References to "accounts," "trading," "traders," "funded," "profit," "capital," "payout," "drawdown," or "position" strictly describe performance within a simulated environment for evaluation purposes only. Participants do not deposit funds, do not place real orders, and do not invest in any securities, commodities, futures, options, swaps, forex, or any other financial instrument.
No participant on our platform has any exposure to real market risk, counterparty risk, or credit risk. All "gains" and "losses" are purely notional and exist only within the simulated environment.
U.S. COMMODITY FUTURES TRADING COMMISSION ("CFTC") NOTICE: Trading futures, options on futures, and retail off-exchange foreign currency transactions involves substantial risk of loss and is not suitable for all investors. Past performance is not indicative of future results.
Alpha Trader Firm does not engage in any of the above-described trading activities. All references to "trading" on our platform relate exclusively to simulated, demo-environment activities with virtual funds.
Alpha Trader Firm is not registered with, regulated by, or affiliated with the CFTC, SEC, FINRA, NFA, SIPC, or any other federal, state, or international financial regulatory authority. Our services do not require such registration because no commodity interest transactions, securities transactions, or investment activities occur on or through our platform.
To access our services, you must create an account by providing accurate, current, and complete information. You are responsible for: maintaining the confidentiality of your account credentials; all activities that occur under your account; immediately notifying us of any unauthorized access or security breach; and ensuring that your registration information remains accurate and up to date.
You may not create multiple accounts, share your account credentials with third parties, or transfer your account to another person. We reserve the right to suspend or terminate accounts that violate these provisions.
All fees for our evaluation services are displayed on our Website at the time of purchase. Fees are charged in U.S. Dollars (USD) unless otherwise specified. By completing a purchase, you authorize us to charge the applicable fee to your selected payment method.
All payments are processed through PCI-DSS compliant third-party payment processors. We do not store your full credit card information. Prices are subject to change without notice, but changes will not affect previously completed purchases.
Promotional codes and discounts: Promotional codes are subject to specific terms and conditions, may have expiration dates, and may be revoked at any time. Only one promotional code may be applied per purchase unless otherwise stated.
Refund eligibility is determined based on the following criteria: refund requests must be submitted within 14 days of purchase; the evaluation account must not have been activated or used (no trades placed); and refund requests must be submitted via email to [email protected].
No refunds will be issued after the evaluation has been activated or any simulated trades have been placed. Chargebacks or payment disputes initiated without first contacting our support team may result in immediate account termination and a permanent ban from our services.
Each evaluation program has specific rules, objectives, and parameters that participants must adhere to, including but not limited to: profit targets, maximum daily loss limits, maximum overall loss limits, minimum and maximum trading days, permitted trading instruments and hours, and position sizing and leverage restrictions.
Complete evaluation rules are provided at the time of purchase and within your account dashboard. Violation of any evaluation rule may result in immediate failure of the evaluation, with no refund or compensation. We reserve the right to modify evaluation rules at any time, with changes applying to new purchases only.
Participants who successfully complete the evaluation phase may be offered access to a "Funded Account Phase." This phase involves continued simulated trading in a demo environment with the potential to earn discretionary rewards based on performance.
The Funded Account Phase does not involve: access to real capital or live trading accounts; employment, independent contractor, or agency relationship with Alpha Trader Firm; authorization to trade on behalf of any entity; or any guarantee of continued access or rewards.
We reserve the right to modify, suspend, or terminate the Funded Account Phase at any time, for any reason, at our sole discretion.
Rewards are discretionary incentive payments that may be offered to participants who meet specific performance criteria during the Funded Account Phase. Rewards are: not guaranteed; not based on real market performance or investment returns; granted solely at the discretion of Alpha Trader Firm; subject to identity verification (KYC) and compliance checks; and subject to applicable tax withholding and reporting requirements.
Alpha Trader Firm reserves the right to withhold, delay, or deny any reward payment if there is reasonable suspicion of rule violations, fraud, or manipulation. Reward amounts, schedules, and eligibility criteria are subject to change at any time.
The following activities are strictly prohibited and may result in immediate account termination without refund:
We reserve the right to suspend, restrict, or terminate your account at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to: violation of these Terms or any evaluation rules; fraudulent, deceptive, or manipulative activity; failure to pass identity verification; inactivity for an extended period; and any conduct that we determine, in our sole discretion, to be harmful to our business, reputation, or other users.
Upon termination, your access to all services will be immediately revoked. Any pending or unpaid rewards may be forfeited. Termination does not relieve you of any obligations incurred prior to termination.
All content, materials, software, trademarks, logos, trade names, and intellectual property on our Website and platform are the exclusive property of Alpha Trader Firm LLC or its licensors and are protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our services for personal, non-commercial purposes only.
You may not: reproduce, distribute, modify, or create derivative works from our content; use our trademarks or branding without prior written consent; scrape, crawl, or extract data from our platform using automated tools; or use our intellectual property for any commercial purpose without authorization.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that: our services will be uninterrupted, error-free, or secure; results obtained from our services will be accurate or reliable; any defects in our services will be corrected; or our platform will be free from viruses or other harmful components.
HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. Past performance in a simulated environment is not indicative of future results in any context.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALPHA TRADER FIRM LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of our services.
OUR TOTAL AGGREGATE LIABILITY for any and all claims arising out of or relating to these Terms or your use of our services shall not exceed the amount you paid to Alpha Trader Firm in the twelve (12) months immediately preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Alpha Trader Firm LLC, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use of our services; your violation of these Terms; your violation of any applicable law or regulation; your violation of any third-party rights; any content you submit or transmit through our platform; and any fraudulent, deceptive, or manipulative activity by you.
This indemnification obligation shall survive the termination of your account and these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Natrona County, Wyoming, and you consent to the personal jurisdiction of such courts.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Casper, Wyoming. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. The arbitrator shall have no authority to award class-wide relief or to consolidate claims.
YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE ACTION against Alpha Trader Firm LLC. You agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
We reserve the right to modify, amend, or update these Terms at any time, at our sole discretion. Material changes will be communicated via email or prominent notice on our platform at least 30 days before they take effect. Your continued use of our services after the effective date of any modifications constitutes acceptance of the updated Terms.
If you do not agree to the modified Terms, you must discontinue use of our services before the effective date of the changes.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, Legal Disclosure, and Cookies Policy, constitute the entire agreement between you and Alpha Trader Firm LLC regarding your use of our services, superseding all prior or contemporaneous agreements, communications, and proposals.
